K-3 Spousal Visas / Visa Petitions vs IR-1 / CR-1 Family Based Petitions for your Spouse / Wife or Husband The K-3 Spousal Visa / Petition has been a faster method of getting your Bride / Husband by your side than the IR or CR options Now however, as the IR-1 and CR-1 methods time elements have been reduced and the K-3 Spousal Visa is rapidly becoming obsolete. At this point, it is still an option. Please read the following so that you will be aware of what may be happening with your Visa / Petition The IR / CR Filings are now being processed much faster The result of this is that the K-3 Spousal Visa Filing will no longer be needed soon Filing a K-3 involves Filing your I-130 Application for Foreign Spouse - Wife or Husband Where as the I-130 is also applicable for other Family members ( such as Parent / Children / Sibling or other Family members ) it does not apply to the K-3 for any other Family Member other than the Spouse and derivative Children, the K-3 applies only for the Spouse and derivative ( if any, under 21 and unmarried ) For the K-3 you will file first the I-130 and you will wait for the I-797C Notice of Action Once that is received, the I-129F, Petition for Alien Fiancee', but used for the Spouse, will be filed If the I-129F is approved before the I-130 is approved then it remains in K-3 Status Keep in mind that the I-129F will typically be filed about 4 to 6 weeks after the I-130 If the I -130 is approved before, or at the same time as the I-129F is approved, it will automatically go to IR / CR Status What this means for you is that the time element is now a little longer as the AOS (Adjustment of Status), will now be handled through the NVC prior to her getting here to the U.S.A. At that point your Spouse will have their Green Card Status when they arrive in the U.S. If it does remain in K-3 Status your approval should come with in 3 to 5 months, after the filing for the I-129F, and the Spouse ( and Child(ren), will proceed to the Medical and then the U.S. Embassy in Manila for the Interview Our average is 3.25 months. We have received approvals as quickly as 1 month and 3 days (unusual) We have also had them approved in 2.5 months. They are currently at about 4 months but could be sooner The average time for approval, stated by the USCIS on their site is 5 months The fee for the Medical, paid to St. Luke's in Pesos at the time of the Medical Check up is $213.35 for adults and $181.35 for children 13 years old or younger The fee for the Interview at the U.S. Embassy, Paid through an accepted bank in the Philippines, is $350.00 per person The forms needed, and guidance necessary for your Spouse to accomplish this is provided by YFW Visa Services If you have paid for the YFW K-3 Complete through Interview at $595.00 then the $200.00 will be due at the time that we handle your NVC requirements if it has gone to IR / CR Status. Otherwise, if the K-3 Status remains in effect, you can pay the discounted rate of $300.00 after your Spouse arrives in the U.S., on a K-3 (regularly $495.00) With the K-3 Complete with AOS you save $195.00 off of the total individual packages if you signed up for the K-3 Complete with AOS with YFW This of course, is relative to who you signed up with, and what their fees are, if it was not YFW, for the K-3 Visa Service We have yet to find another Service that offers all of the hands on help and guidance that we offer at any price most of which are twice the amount of our fees We discuss this on our pages regarding K-1's and K-3's / K-2's and K-3's, Derivative ( Children ) Availability via phone calls, IM, Skype, Email to all involved The same applies for the IR / CR Status If your K-3 goes to IR / CR Status you will receive a notice from the NVC regarding the I-864 Affidavit of Support fee for $88.00 and following that you will receive an email from the NVC for the Immigration fee for $404.00 Once this happens, If it does go to the IR / CR rather than remain in K-3 Status, it will take a little longer The benefit is that you will save $1,070.00 on your Government fee for AOS and once your Spouse is here they are Green Card ready How ever you will need to file a petition for each of the Family members and pay the Government fees for each petition but save the AOS fees which are substantially more What we recommend is to file for IR / CR Status, Know that it may take a little longer and save the money rather than have to deal with incorporating the other petitions for the Children if there are Children involved If you have any questions or would like to begin the K1 Fiancée Visa or K3 Spousal Visa process IR-1 / CR-1 Petitions CONTACT US 713-301-5075 or Email us @ EMAIL VISA SERVICES |
